We believe that your bank no longer has a legal basis for continuing with foreclosure  proceedings.
Simply, the reason you entered into a home loan was to provide you and your family with security.
This cannot be the case if your bank is threatening you by attempting to collect your arrears on the one hand but is increasing your installment on the other.
It is a catch 22; Your arrears increase but you cannot negotiate because your bank requires a lump sum payment far exceeding your ever growing arrears.


Our Process

After we have received the documents and the initial payment referred to below, we will provide you with an Opinion and a Notice of Intention to Defend/Oppose the Summons or Application.
Thereafter you will decide whether you want to sign up to Option 1, 2 or 3, also referred to below. Once you have done so we will then draft the opposing documentation and assist you with taking the matter further as and when needed.


What documentation we initially need

  • Bank Statements from the beginning of the Loan account; and
  • Any letters received from the bank regarding;
    • Rate changes or instalment changes; and
    • Cession of the agreement to another entity (if and where applicable); and
    • Non-payment; and
  • A copy of the Summons/Application (the Legal Documents you have received)

We require you to complete this Basic Home Loan Form before we can log you onto our system:


Opinion

Once you have provided us with the documentation and information referred to above we will require a payment of R1 500 where after we will be in a position to draft the Opinion detailing what defences are available to yourselves and what we believe the best way to handle you matter.

Assistance Options

After receiving our opinion you will need to decide what to do next whether you want to use our services in helping you save your home or you want to go it alone, in which case we do offer a free advice line.
If you decide that you want our assistance we offer 3 options:

Option 1: You do: Sign Up
R2 500 per month (less disbursements).
This amount is capped at:

  • Default/Summary Judgment Opposing Affidavit: R5 000
  • Trial: R15 000

Option 2: We do: Sign Up
R3 000 per month (less disbursements).
We take a Power Of Attorney to retrieve documentation required and we handle the serve and filing of court documents.
This amount is capped at:

  • Default/Summary Judgment Opposing Affidavit: R6 000
  • Trial R18 000

Option 3: We Still Do: Sign Up
R1 500 pm month (less disbursements).
We take a Power Of Attorney to retrieve documentation required and we handle the serve and filing of court documents.
This amount is uncapped and is payable until the end of the matter.
